Terms of sale of the CBELIER books

In short: the e-book purchased (PDF) — and, for book 1, its example files — can be downloaded from your account as soon as the payment is received. The books are written in French. Your copy is personal and bears your name. Corrections to the edition purchased are provided free of charge. By asking for immediate access, you waive the right of withdrawal for this digital content.

1. Seller and purpose

These terms govern the online sale, on cbelier.alfawamane.ma, of the following e-books, sold separately: book 1, « CBELIER — Fondements, vérification et validation d'un logiciel de calcul des régimes transitoires » [CBELIER — Foundations, verification and validation of a transient-flow calculation software] (PDF file and the example files that come with it); book 2, « CBELIER — Fondements scientifiques du calcul des régimes transitoires. Équations, méthodes numériques et organigrammes » [CBELIER — Scientific foundations of transient-flow calculation. Equations, numerical methods and flowcharts] (PDF file only). The seller is ALFA WAMANE SARL AU, Imm. n° 5, rue Dakar, bureau n° 1, Océan, Rabat, Morocco (RC 169351, ICE 003311083000033, IF 53830992), contact: alfawamane@gmail.com. The purchase of calculation credits is not covered.

2. Order

• The order is placed from an online CBELIER account (Account menu of the application), book by book.
• The customer gives the billing name, printed on the invoice and on the copy. The customer accepts these terms and the licence of the book ordered (book 1, book 2); the version accepted and the date of acceptance are recorded with the order.
• The order is confirmed by the payment (PayPal or card) or, for a bank transfer, on receipt of the funds.

3. Price

• Prices are shown on the page of each book: in euros including all taxes for payment by PayPal or by card, in dirhams excluding tax, VAT extra, for payment by bank transfer. The price applicable is the one shown at the time of the order.
• Student / teacher price (book 1 and book 2): on request from the account (institution and institutional e-mail address), granted after review by ALFA WAMANE. An accepted request applies to both books, once per book.
• No bundle combines the two books.

4. Payment

• PayPal or bank card: the payment is entered at PayPal; CBELIER never receives the card details.
• Bank transfer: the customer makes the transfer quoting the order reference; the book is made available as soon as the funds are received. An unpaid order may be cancelled.
• An invoice is issued for each payment. It is sent by e-mail and remains available in the account (Account › My documents).

5. Delivery

• The book purchased (and, for book 1, its example files) is made available in the account (Account › My documents) as soon as the payment is confirmed.
• Each download produces a personalised copy: the customer’s name and e-mail address, the order reference and a copy identifier are printed on it.
• The number of downloads per version is limited (it is shown in the account); each download link is personal, single-use and time-limited. Beyond that, the customer writes to alfawamane@gmail.com to have the counter reset.

6. Benefits linked to the purchase of book 1

• Trial credits: a purchase at the public price credits the account with the number of trial credits shown on the page of the book.
• Credit note: when the page of the book says so, a purchase at the public price gives the right to a credit note in credits, for the amount and the period shown there, paid once on the first credit pack purchased during that period. The credit note is not refundable, not convertible into money and not transferable; it cannot be combined with the book offered with a pack.
• Book offered with a pack: the purchase of one of the credit packs shown on the page of the book adds the book to the account, if the account does not already have it.
• Student / teacher price: neither trial credits nor credit note.
• Purchase on Payhip: a purchase of the book made on Payhip is linked to the CBELIER account with the same confirmed e-mail address; it gives access to the updates and to the trial credits, without credit note. The payment, the invoice and the refund of this purchase are the responsibility of Payhip.
• The examples of book 1 are calculated in CBELIER without debiting credits.
• Book 2: none of these benefits applies (no trial credits, no credit note, no book offered with a pack); it benefits from the student / teacher price described in article 3. A purchase of book 2 made on Payhip is linked to the CBELIER account with the same confirmed e-mail address and gives access to the updates of the edition purchased.

7. Updates

Corrections and new versions of an edition are offered to the buyers of that edition and made available in their account. A new edition is sold separately.

8. Right of withdrawal

Each book is digital content supplied on an intangible medium. When ordering, the customer expressly asks for immediate access to the book and acknowledges that he or she thereby waives the right of withdrawal as soon as the book is made available, under the conditions provided by the regulations applicable to consumer protection.

9. Refunds

• A duplicate payment for the same book is refunded by ALFA WAMANE.
• If the book cannot be downloaded and support (alfawamane@gmail.com) cannot resolve the problem, the customer is refunded.
• A refund removes access to the refunded book; trial credits already paid (book 1) remain acquired.

10. Licence and intellectual property

The books and the example files are protected by copyright. Their use is governed by the licence of each book (book 1, book 2): personal copy, no redistribution, posting online or resale.

11. Liability

The books set out calculation methods and examples. The results presented do not release the engineer from checking his or her own studies; ALFA WAMANE cannot be held liable for the use made of them. The conditions of use of the software are set out in the legal notice.

12. Personal data

The data related to the order are processed according to the privacy policy.

13. Applicable law and disputes

These terms are governed by Moroccan law. In the event of a dispute, the customer first contacts alfawamane@gmail.com for an amicable solution. Failing that, the courts of Rabat have jurisdiction, subject to the mandatory provisions protecting consumers.
